Defining Offensive Waste
Offensive waste is also known as hygiene waste or non-infectious waste. It’s called offensive waste because of its appearance, smell or general nature, but it’s neither infectious nor hazardous.

By law, businesses are required to separate offensive waste from other types of waste streams and store it safely within the appropriate offensive waste bins until collection.

What Happens To Offensive Waste?
Offensive waste must be segregated into yellow and black tiger-striped offensive waste bags, the UK standard colour for offensive waste disposal. Bags should be sealed and tied, but not overfilled (approximately three-quarters full is best).
Offensive waste is then collected by a licensed waste carrier and taken to an authorised treatment facility. Most offensive waste will be treated using energy-from-waste processes if facilities are available locally. This allows companies to recover energy from waste, while ensuring it’s disposed of in a responsible manner.
Offensive waste does not need to undergo high-temperature treatment like clinical waste. Segregating your waste will ensure your business only pays for the services it needs, helping you to cut disposal costs and stay compliant.
Each collection comes with a Waste Transfer Note, which you are required by law to retain for at least two years.
Offensive Waste Regulations
If your business produces offensive waste, you are responsible for ensuring that it’s stored, transported and disposed of safely. Although offensive waste isn’t infectious, there are still UK laws governing the management of this type of waste. You must deal with it safely to protect others, the environment and your business.
Under The Environmental Protection Act 1990, businesses have a Duty of Care to ensure waste is managed responsibly, from when it’s produced all the way through to its final disposal. Businesses are also required to follow the waste hierarchy where possible and segregate their waste into the correct waste streams under The Waste (England and Wales) Regulations 2011.
Offensive waste is defined as a controlled waste stream under The Controlled Waste (England and Wales) Regulations 2012. Healthcare and related organisations should also adhere to Health Technical Memorandum (HTM) 07-01: Safe Management of Healthcare Waste. HTM 07-01 is best practice guidance which looks at the segregation, storage and disposal of offensive waste. This includes how to use tiger-striped yellow and black bags correctly.
